Agreement to Terms

By accessing or using BranchedAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

BranchedAI provides a platform for branching AI conversations, allowing users to explore multiple conversation paths with various AI models including ChatGPT, Claude, Gemini, and DeepSeek. The Service operates on a credit-based system.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

Credits and Payments

Credit System

Our Service operates on a credit-based system. Credits are used to generate AI responses and must be purchased in advance. Different AI models may consume different amounts of credits per request.

Pricing and Payment

• All prices are displayed in US Dollars (USD)
• Payment is processed through Stripe
• Credits are non-refundable once purchased
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

Credit Expiration

Credits do not expire as long as your account remains active. Inactive accounts (no login for 12 months) may have their credits forfeited.

Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate harmful, abusive, or illegal content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for automated bulk requests without permission
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract source code

Content and Intellectual Property

Your Content

You retain ownership of the prompts, conversations, and content you create. By using the Service, you grant us a license to process, store, and display your content as necessary to provide the Service.

AI-Generated Content

Content generated by AI models is subject to the terms of the respective AI providers. We make no warranties regarding the accuracy, completeness, or reliability of AI-generated content.

Our Intellectual Property

The Service, including its design, features, and functionality, is owned by BranchedAI and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Service without permission.

Third-Party Services

Our Service integrates with third-party AI providers (OpenAI, Anthropic, Google, DeepSeek, etc.). Your use of these models is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

Disclaimers and Limitations of Liability

Service "As Is"

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Availability

We do not guarantee that the Service will be available at all times or error-free. We may suspend or terminate the Service for maintenance or other reasons without prior notice.

Limitation of Liability

To the maximum extent permitted by law, BranchedAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless BranchedAI from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease, and any unused credits will be forfeited.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Mexico.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
